1. About AssessKit

AssessKit is a software-as-a-service (SaaS) tool designed to help UK fire risk assessors create fire risk assessment reports structured per PAS 79:2020, manage clients, and track recommended actions.

Important: AssessKit is a tool. It provides structure and templates for producing fire risk assessment reports. It does not provide fire safety advice, consultancy, or professional opinions. AssessKit does not guarantee that any report produced using the service is compliant with PAS 79:2020, the Regulatory Reform (Fire Safety) Order 2005, or any other legislation or standard. Compliance with all applicable laws, standards, and professional obligations is entirely the responsibility of the assessor using the service.

We use the phrase "structured per PAS 79:2020" to describe the format of reports produced through AssessKit. This means the report template follows the general structure outlined in PAS 79:2020. It does not mean that any individual report produced is compliant, complete, or suitable for any particular purpose. That determination rests solely with the qualified fire risk assessor who authors the report.


2. Account Terms

2.1. You must be at least 18 years old to create an account.

2.2. You must provide accurate and complete information when registering. You are responsible for keeping your account credentials secure.

2.3. Each account is for a single individual or organisation. You may not share login credentials with others unless your subscription plan explicitly permits multiple users.

2.4. You are responsible for all activity that occurs under your account.

2.5. We reserve the right to suspend or terminate accounts that violate these terms (see Section 9).


3. What We Provide

3.1. Access to the AssessKit web application for creating, editing, storing, and exporting fire risk assessment reports.

3.2. Tools for managing client and site records, tracking findings and recommended actions, and generating reports structured per PAS 79:2020.

3.3. Data storage for your assessment data, uploaded photos, and generated reports for the duration of your active subscription.

3.4. We aim to keep AssessKit available and functioning, but we do not guarantee uninterrupted or error-free service. We may carry out maintenance, updates, or changes to the service from time to time.


4. Acceptable Use

Your use of AssessKit is subject to our Acceptable Use Policy. In summary, you agree to use the service only for its intended purpose — producing and managing fire risk assessments — and not to misuse, abuse, or interfere with the service or other users' data.


5. Payment Terms

5.1. AssessKit is a paid subscription service. Prices are listed on our website at assesskit.co.uk and are stated in British Pounds (GBP).

5.2. Subscriptions are billed monthly or annually via Stripe, our payment processor. By subscribing, you authorise recurring payments at your chosen billing interval.

5.3. We do not store your card details. All payment information is handled directly by Stripe. For details on how Stripe processes your data, see Stripe's privacy policy.

5.4. We may change our pricing from time to time. We will give you at least 30 days' notice before any price increase takes effect. If you do not agree to the new pricing, you may cancel your subscription before the change applies.

5.5. Refunds are handled on a case-by-case basis. If you believe you have been incorrectly charged, please contact us at legal@assesskit.co.uk.


6. Cancellation

6.1. You may cancel your subscription at any time through your account settings or by contacting us at legal@assesskit.co.uk.

6.2. When you cancel, your account will remain active until the end of your current billing period.

6.3. After your billing period ends, your account will enter a 30-day read-only grace period. During this time, you can log in and view or export your data, but you cannot create new assessments or edit existing ones.

6.4. After the 30-day grace period, your account will be deactivated. You may request deletion of your data at any time (see our Retention and Deletion Policy).

6.5. If you wish to reactivate your account during or after the grace period, contact us at legal@assesskit.co.uk.


7. Your Data

7.1. You own your data. All assessment data, client information, reports, photos, and other content you create or upload to AssessKit belongs to you.

7.2. You grant us a limited licence to store, process, and display your data solely for the purpose of providing the AssessKit service to you. We will not use your data for any other purpose.

7.3. You can export your data at any time using the export features within the application (CSV export and report downloads).

8. Liability Limitations

8.1. AssessKit is provided "as is" and "as available." To the fullest extent permitted by law, we exclude all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2. AssessKit provides report structure and templates structured per PAS 79:2020. It does not guarantee that reports produced are compliant with PAS 79:2020 or any other standard, regulation, or legislation. The content, accuracy, and completeness of any fire risk assessment report is the sole responsibility of the qualified fire risk assessor who authors it.

8.3. We are not liable for any loss, damage, or claim arising from reliance on reports produced using AssessKit, including but not limited to claims relating to fire safety, regulatory compliance, property damage, or personal injury.

8.4. To the fullest extent permitted by law, our total liability to you for any claims arising from your use of AssessKit shall not exceed the total amount you have paid to us in the 12 months immediately preceding the claim.

8.5. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.


9. Termination

9.1. We may suspend or terminate your account if you breach these terms, the Acceptable Use Policy, or if we are required to do so by law.

9.2. Where reasonably possible, we will give you notice before terminating your account and an opportunity to export your data. In cases of serious or repeated violations, we may terminate immediately.

9.3. On termination, the provisions of these terms relating to data ownership (Section 7), liability limitations (Section 8), and dispute resolution (Section 10) will continue to apply.


10. Dispute Resolution

10.1. These terms are governed by the laws of England and Wales.

10.2. If you have a dispute with us, please contact us at legal@assesskit.co.uk first. We will try to resolve matters informally.

10.3. If we cannot resolve a dispute informally, the courts of England and Wales shall have exclusive jurisdiction.


11. Changes to These Terms

11.1. We may update these terms from time to time. We will notify you of material changes by email or through the application.

11.2. Your continued use of AssessKit after changes take effect constitutes acceptance of the updated terms. If you do not agree with the changes, you should cancel your subscription.
